مفكر متميز استطاع كسر أغلال السلفية التي كبلته لعقود من الزمن. قاضٍ مصري سابق من مواليد 1954، تخرج من كلية الحقوق في جامعة القاهرة سنة 1976، وتدرج في سلك النيابة العامة والقضاء منذ تخرجه. له مؤلفات في الفكر السياسي والفقه الدستوري، آخرها: تطور الفكر السياسي في مصر خلال القرن التاسع عشر.
كان آخر إصدار له كتابه "الدين والتدين".

لقد أصبح "السلف" - وهو تعبير غامض يحتاج إلى الضبط والتحديد - مصدراً للتشريع بما يخالف الشريعة، ففعل "السلف" الذي وافق على الإنقياد لأنظمة فاسدة يصبح "دليل" حكم بجواز ذلك الإنقياد، وهذا نموذج لعلاقة التاريخ السياسي بتاريخ الفقه، نموذج ليس فقط لتنحية النص، بل لطريقة رسمه وإنشائه وتكوينه.
فمنذ أن دُوِّنَت النصوص، ولا سيما السنّة، في كتب مستقلة كمتون سرديّة صرف، بغير إشارة إلى سياقات الواقع التي كانت تلابسها في لحظات التلقي الأولى، أو في ظروف التدوين المتأخرة، والعقل الإسلامي يتعاطى معها ككائنات تشريعية مطلقة وكاملة الكينونة، بمعزل عن العوامل الخارجية.
لقد قرأنا بعض الأحاديث في كتب السنّة الصرف فلم نفهمها، ولما قرأناها في كتب التاريخ فهمناها، كما قرأنا أحاديث في كتب السنّة الصرف فقبلناها، ثم قرأناها في كتب التاريخ فلم نقبلها.
لذلك ارتأينا القراءة في النص على ضوء التاريخ وفي التاريخ على ضوء النص، وفي ظل التحولات التي تشهدها منطقتنا، حيث تسلّم السلطة في أكثر من بلد عربي أحزاب إسلاميّة، يصبح نقاش علاقة السلطة بالدين أمراً أكثر إلحاحاً، وهذا مدار الكتاب.
