عن "السيادة"، المفهوم القانوني والسياسي المُتغير والمُلتبس، منذ تأسس في فرنسا قبل ستة قرون، تعبيراً عن الحق الإلهي وتمثّلاً له، ثم تحول المفهوم على يد جان بودان ثم هوبز ليعبر عن السيادة المُطلقة للملك باعتباره محتكر السلطة ومصدر الحق والقانون، وذلك بهدف إنهاء الانقسامات والحروب الدينية بين البروتستانت والكاثوليك، ثم تطور المفهوم تدريجياً عقب معاهدة وستفاليا ثم الثورات الأوروبية ليعبر عن دولة الدستور الممثل للسيادة الشعبية، وحتى العصر الحديث الذي يوصف بحقبة "ما بعد السيادة" وذلك بوجود مؤسسات دولية تمثل - بشكلٍ ما - سُلطة متجاوزة للحدود والقوانين المحلية والمعبّرة عن مرجعية غربية قسرية "الأمم المتحدة، الإعلان العالمي لحقوق الإنسان، منظمة التجارة، البنك الدولي ...إلخ"، بشكلٍ قد تبدو فيه هذه المؤسسات متضادة مع الديمقراطية لكونها باتت سلطة قانونية حاكمة حتى على اختيارات شعب ما داخل دولة. فيما يرى بعض علماء القانون أن وجود مبادئ "فوق وطنية" ينطوي على حماية للديمقراطية ولحقوق الإنسان، لذلك دعوا إلى ما سموه "أنسنة السيادة" بهدف منع انتهاكات حقوق الإنسان داخل الدول. ويؤكدون أن السيادة فقدت مكانتها كمبدأ أول في القانون الدولي، وحلت محلها قاعدة معيارية جديدة ترتكز على الفرد وحقوقه.
