هذا الكتاب قواعد الفقه- وكذا القانون- منها ما يتعلق بالوسائل ومنها ما يتعلق بالغايات، فحيثما كانت الغاية مشروعة، كانت الوسيلة- في الغالب- مشروعة أيضاً، إذ يفترض إعطاء الوسيلة حكم غايتها، ومن هنا قال الأصوليون (ما لا يتم الواجب به فهو واجب) وحيثما كانت الغاية ممنوعة، كانت الوسيلة إليها ممنوعة أيضاً، إذ ليس منطقياً أن تحرم قاعدة معينة تصرفاً معيناً وتبيح في الوقت ذاته الوسائل التي تؤدي إلى ذلك التصرف، ومن هنا قالوا (كل ما أدى إلى الحرام فهو حرام)، لكن يدق الأمر إذا كانت الوسيلة مشروعة في ذاتها لكن يغلب على الظن افضاؤها إلى مفسدة معينة، وهذا الكتاب يتناول تفاصيل هذه الحالة وملابساتها في إطار أصول الفقه الإسلامي وفي نطاق القانون بحث موسع مسهب، نرجو أن يكون قد وفق فيما توخى إليه....
