ظهر لدى العلماء مصطلح (سد الذرائع) وأرادوا به منع الوسائل وإن كانت مشروعة في ذاتها إذا كانت تؤدي إلى نتائج غير مشروعة، تتعارض مع قاعدة جلب المصالح ودرء المفاسد، وجعلوا من هذا الأصل وسيلة لمنع التحايل على الأحكام الشرعية الثابتة.
وإذا كان الفقه الإسلامي قد تمكن بواسطة سد الذرائع من منع وسائل مشروعة، تؤدي في مآلها إلى نتائج غير مشروعة، فكيف هو الحال في القانون الوضعي؟ وكيف تمكن هذا القانون من أن يواجه مثل هذه الحالات بصورة عامة؟
هذا هو ما دفعني إلى اختيار هذا الموضوع هدفًا لبحثي، وقد شرعت في هذا البحث مبتدئًا بتعريف الذرائع سدًا وفتحًا في اللغة والاصطلاح، وبيان الأصل الذي بنيت عليه قاعدة سد الذرائع، وما يتفرع عن هذا الأصل من قواعد ضمن فصل أول. في حين تناول الفصل الثاني بيان مواقف العلماء من سد الذرائع، ومناقشة تلك المواقف وتقويمها والوقوف على حقيقة الآراء الخلافية في هذا الصدد. أما الفصل الثالث فقد تضمن البحث في التكييف الأصولي لسد الذرائع وبيان أقسام الذرائع. ثم تم في الفصل الرابع تسليط الضوء على مكانة سد الذرائع في كل من السياسة الشرعية والتشريعية، وتطبيقاتها في كل من الشريعة والقانون. وأخيرًا تركز البحث في الفصل الخامس والأخير حول الباعث الدافع غير المشروع في كل من الفقه الإسلامي، والقانون الوضعي. وأنهيت الفصول بخاتمة تضمنت أهم النتائج.
