إن البحث في فقه الشعائر الإيمانية بشكل عام، والشعائر الحسينية بشكلٍ خاص، هو من اهمّ المعارف البراءتية التي تقوم على أصل التبرِّي من أعداء آل البيت عليه السلام إذ إنَّ التبري - بمفهومه ومنظومته العقائدية المعرفية - متقدِّمٌ على مفهوم التولّي لأهل البيت عليهم السلام وليس من الصواب ما ذهب إليه ثلةٌ من المتأخرين بإدراجهم مفهومَي التولِّي والتبرِّي في خانة الفروع الفقهية، ظناً منهم أنَّهما - أي التولي والتبري - متعلقان بأفعال المكلَّفين، وهو تصوُّر ساذج لم يرسِ على قاعدة عقائدية صحيحة، وينم عن ضعف ذويه في تحصيل المعارف الإلهية، فضلاً عمّا لهذا التصور من خلفياتٍ أشعرية تبتغي تسطيح مفهوم الإمامة والولاية، وبالتالي إسقاطهما من قاموس الأصول الإعتقادية، ومن ثَمَّ إسقاط الآثار واللوازم على منكرهما، وهو الكفر؛ إذ إن الإسقاط المذكور - بحسب نظرهم القاصر - يدخل صاحبه في باب العصيان الذي لا يستوجب التكفير والخلود في النيران... بل إن منكرهما - بحسب زعمهم - يُعتَبَرُ عاصياً وآثماً، يستحق العقاب لفترة؛ تماماً كغيره ممن ترك العبادة والطاعة، ومال إلى التحلل والمعصية...!.
