الحساب الجاري هو عقد متبادل بين طرفين تستدعي أحوالهما أن يتبادلا تسليم الأموال ويتفقان بموجبه على تحويل ما لهما من الديون إلى بنود بسيطة للتسليف والتسلف يتألف منها حساب واحد، بحيث يصبح الرصيد النهائي وحده عند إقفال هذا الحساب ديناً مستحقاً ومهيئاً للأداء، وهكذا فإن الديوان الداخلة في الحساب الجاري تفقد ذاتيتها وتندمج فيه. والجدير ذكره أنه لا يشترط أن يكون طرفا العقد تجاراً.
هذا وقد سار الاجتهاد على إمكانية اعتبار عقد فتح الاعتماد بالحساب الجاري سنداً تنفيذاً وعلى اعتبار الرصيد النهائي بعد تصفية الحساب ديناً أكيداً معين المقدار ومستحق الأداء، أما كشف الحساب فيمكن تنفيذه مباشرة أمام دائرة التنفيذ وهو يخضع لمرور الزمن العشري.
أما بالنسبة للفائدة، فهي تتمتع بقواعد خاصة وتحسب إما على المعدل القانوني المتعارف عليه وإما بحسب معدل اتفاقي وقد تحسب أيضاً على أساس مركب.
وأخيراً، يمكن توقيف الحساب الجاري توقيفاً مؤقتاً كما يمكن إقفاله نهائياً وفي هذه الحالة الأخيرة فقط يصبح الرصيد النهائي ديناً مستحق الأداء، أما أسباب الإقفال فتكون إرادية أو غير إرادية...
