إن قضية المواد المحرمة والنجسة المستخدمة في الأدوية والأغذية وما يتفرع عنها من المسائل والجزئيات، من الأمور المهمة التي تشغل بال كثير من المسلمين في هذا الزمان، ويتكرر السؤال عنها: والاستفتاء فيها في سائر الديار التي يعيش فيها المسلمون وخصوصاً في البلدان الغربية، لملابستها لمعيشتهم وصلتها باحتياجاتهم، وتعذر الانفكاك عن العلاقة بها في كثير من الأحيان، بداعي الضرورة، أو عموم البلوي، أو مسيس الحاجة، أو غير ذلك.
وقد عمدت إلى إعداد هذه الدراسة العلمية المنهجية المؤصلة، لعلها تنير السبيل، وتساهم في رفع الحرج عن الناس، وجلب المصالح المعتبرة لهم، ودفع المفاسد والآثام عنهم، فإن الشريعة مبناها على تحصيل المصالح وتكميلها، وتعطيل المفاسد وتقليلها، بحسب الإمكان، ومطلوبها ترجيح خير الخيرين، إذا لم يكن أن يجتمعا جميعاً، ودفع شر الشرين، إن لم يندفعا جميعاً.
هذا وقد اقتضت مني طبيعة هذا البحث أن أقسمه إلى فصلين: أحدهما في المقدمات والثاني في المقاصد، مع ملحق وخاتمة. أما المقدمات فهي ست: الأولى: قاعدة الأصل في الأعيان الحل والطهارة، الثانية نظرية الاستحالة للمواد النجسة والمحرمة، الثالثة: نظرية الاستهلاك للمواد النجسة والمحرمة. الرابعة: نظرية الضرورة، والحاجة للتداوي، الخامسة: هل الخمر نجسة العين؟، السادسة: هل المخدرات نجسة العين؟
وأما المقاصد (المبنية على تلك المقدمات) فتتضمن تسع قضايا: الأولى: الكحول الإثيلي واستعمالاته، الثانية: نجاسة الميتة، وحكم الجبن المنعقد بإنفحتها، الثالثة: مشتقات الخنزير في الأغذية والأدوية وغيرها، الرابعة: الدم ومشتقاته في الأغذية والأدوية، الخامسة: تنقية مياه المجاري بوسائل التقنية الحديثة، السادسة: تغذية الحيوانات بالأعلاف النجسة، السابعة: استخدام المخدرات في العلاج الطبي والأغذية، الثامنة: الاستخدامات العلاجية للذهب، التاسعة: ليس الحرير للرجال في العلاج الطبي. وأما الملحق ففي حكم التوسل بالطاهر المباح إلى غرض محظور. وأما الخاتمة ففي أهم نتائج وثمرات البحث.
