يضم هذا الكتاب البحوث والمناقشات التي قُدّمت في ندوة "تعارض المصالح في الدولة والمجتمع" التي عقدتها المنظمة العربية لمكافحة الفساد في بيروت، يومي 15-16/09/2015. وشارك فيها عدد من المسؤولين والناشطين المهتمين بالشأن العام، إضافة إلى بعض الفاعليات البحثية والأكاديمية ممن يمثل الاتجاهات السياسية والاقتصادية والفكرية والثقافية المهتمة بقضايا التنمية والحوكمة ومكافحة الفساد في الأقطار العربية.
يقع موضوع تعارض المصالح لدى المسؤولين في إدارات الدولة العامة وفي المؤسسات الخاصة، وعلى الأخص تلك التي لها طابع النفع العام، في سياق ممارسة "الاستفادة لمصلحة خاصة" في العمل العام. وأرادت المنظمة من خلال هذه الندوة تسليط الضوء على هذه الظاهرة التي باتت مستشرية في منظومة الدولة والمجتمع في بلداننا، لما تسببه من أضرار مسلكية عند ممارسة المسؤولية وفي اتخاذ القرار، وأضرار مادية تجاه النفع العام أو تجاه أطراف آخرين. غير أن الخطر الرئيس الذي تسببه هذه الظاهرة هو في تفشي الفساد في المرافق العامة والخاصة كلها، وتشجيعه كمنصة داعمة لبيئة فكرية وثقافية مجتمعية تستكين للفساد وتحتضن ثقافته من أجل تحقيق مصالح ومآرب وجشع فئة معينة من الناس على حساب المصلحة العامة.
سعت المنظمة في ندوتها هذه إلى كشف تأثير تضارب المصالح في تفشي الفساد في المجتمع من خلال تبيان أثره في مظاهر ثلاثة رئيسة: أولها يتعلق بتضارب الولاء الوطني وما يتصل به من مصالح وأطراف خارج الوطن بما يهدد أمنه وأمن المواطن. وثانيها في تضارب مهمات المسؤول كرقيب وقيّم بين الخاص والعام بما يفقده الاستقلالية والنزاهة في أداء واجباته. وأخيرًا، البحث في إشكالية العلاقة بين الأصيل والوكيل وما يعتريها من تعارض في المصالح. يظهر ذلك مثلاً في العلاقة بين صانع القرار السياسي (الوكيل) والناخبين (الأصيل)، أو في العلاقة بين مجالس الإدارة (الوكيل) والمالكين وأصحاب المنفعة (الأصيل).
