ولكي تكون الدراسة قريبة إلى أفهام المعاصرين فقد اعتمد منهجاً معيناً وهو بحث المسألة المراد عرضها في القانون الدولي الوضعي قبل الدخول في تفاصيل الفقه الإسلامي لكي يفهم المراد من المصطلحات الشرعية وتقريبها إلى مرادفاتها في لغة القانون الوضعي.
فضلاً عن ذلك فإن هناك مسائل ومواضيع في القانون الدولي الوضعي لم يبحثها فقهاؤها من قبل لعدم وجودها على الواقع في ذلك الوقت، ففي هذه الحالة استعرض الموضوع في القانون الوضعي ثم حاول إبراز حكم الشريعة الإسلامية على هذه الوقائع بناء على الأسس والقواعد العامة للشريعة الإسلامية التي تجعلها صالحة لإبداء حكمها في أي واقعة إلى قيام الساعة.
