إن لفظ عدوان هو تعبير حديث إلى حد ما ولكن اللفظ في القانون الدولي سابقاً يطلق عليه الحرب غير العادلة ولكن من خلال مصالح الدول فإنها تعتبر ما هو في مصلحتها غير عدوان وما كان في غير مصلحتها تعتبره عدواناً.
ومع ظهور التنظيم القانوني للمجتمع الدولي أصبح التنظيم يحقق متطلبات ورغبات أعضاء المجتمع الدولي واصبح الحق في اللجوء إلى الحرب ينظم ويقيد وفق التطور الدولي وفي نهاية المطاف منع استخدام القوة في العلاقات الدولية.
ففي ظل ميثاق عصبة الأمم فرضت شروط معينة على الدول للقيام بالحرب ولكن لم تحرمها بتاتاً وهذا يدل على أن الحرب عمل عدواني واعتداء على حقوق وسيادة الآخرين ولكن الميثاق اعتبر الحرب وسيلة مشروعة لاستخلاص الحقوق الدولية إلا أن عصبة الأمم لم تضع تعريفاً محدداً للعدوان.
أمّا في ظل نشوء الأمم المتحدة وفي ظل نظام دولي منظم فقد وجد أنه يجب أن يكون هناك تعريف للعدوان خوفاً من أن يظل تعريفه بيد الدول المتنازعة وبالإضافة إلى ذلك لتحديد المعتدي لتوجيه تدابير الأمن الجماعي وتحديد المسؤولية عليه وفرض العقوبات المناسبة من خلال عمل جماعي منظم ينظم الدول الأعضاء.
وكانت أول خطوة جادة لتعريف العدوان هو مشروع تعريف العدوان الروسي وذلك سنة 1933م وبعد ذلك منظمة الأمم المتحدة حيث قامت سنة 1950م ببحث هذه المشكلة وإصدار قرار بتشكيل لجنة خاصة لدراسة أشكال العدوان وأثر ذلك على حفظ السلام والأمن الدوليين.
