تناولت هذه الدراسة موضوع الخُلع القضائي الذي تم العمل به في المحاكم الشرعية الأردنية بعد تعديل بعض مواد قانون الأحوال الشخصية، حيث بينت الدراسة من خلال المقارنة أن الخُلع القضائي يقوم على مبادرة الزوجة بطلب التطليق بالإرادة المنفردة دون الالتفات إلى رضا الزوج وإرادته، وعلى القاضي تطليق الزوجة طلقة بائنة مقابل أن ترد للزوج المهر المعجل في حال الزواج بعد الدخول، أما عقد الزواج قبل الدخول فعليها إذا اختلعت أن ترجع لزوجها كافة تكاليف الزواج ويقوم القاضي بفسخ عقد الزواج.
ومن خلال دراسة الجانب الشرعي، تم توضيح الكثير من القضايا المتعلقة بالخُلع مثل: مشروعية الخُلع وطبيعته، ونوع الفرقة فيه، والآثار المترتبة عليه، والفرق بين الخُلع والطلاق على مال، ودور القاضي والآثار المترتبة عليه. كما بينت الدراسة الجانب القانوني مُعرفة فيه الخُلع القضائي ومشروعيته والأسباب الموجبة له، مع عرض بعض النماذج التطبيقية للخُلع القضائي والآثار المترتبة عليه، ثم أضافت الدراسة أمثلة لبعض القضايا المفصول فيها داخل المحاكم الشرعية. وتم من خلال الرسالة عرض لبعض قضايا الخُلع ومشكلاته، ومدى أحقية المرأة المسيحية في الخُلع، ثم مقارنة الخُلع في الأردن والخُلع في مصر للطوائف المسيحية.
وبينت الدراسة كيفية رفع دعوى الخُلع، ثم ناقشت اجتهادات وآراء المحكمة الشرعية وأهل العلم الشرعي ووجهات نظر المحامين الشرعية، وآراء مجلس النواب وعلماء الاجتماع حول الخُلع القضائي. ثم قامت الدراسة بالمقارنة بين تقنيات الخُلع والمخالعة، وأبرزت الدراسة الجانب الاجتماعي لتفسير الاتجاهات النظرية للخلع، وتضمنت الاتجاه الاجتماعي والبيولوجي والنفسي لتفسير الخُلع والآثار الاجتماعية المحتمل توقعها على الزوجة والزوج والأولاد.
وبينت الدراسة إحصائيات نسبة الخُلع مقارنةً مع الزواج والطلاق للأعوام 2001 ــ 2004 مع بيان أثر التعليم على الخُلع. وأخيراً، ناقشت الدراسة نتائج الاستبانة التي تم توزيعها على أفراد عينة الدراسة من الذين مروا بتجربة الخُلع، والأسباب المؤدية إلى الخُلع وآثاره المترتبة على الأسرة من وجهة نظرهم. ومن ثم خرجت الدراسة بخلاصة تضمنت أهم النتائج والتوصيات.
