لما كانت العدالة البطيئة ظلماً محضاً، ولما كان تأخيرها كالحرمان منها، فقد سعى الفكر القانونيّ في سيره الحثيث نحو إيجاد حل لمعضلة قد تُطيح إذا ما استمرّت بالنظام القضائيّ بأكمله، فالمتقاضون قد يلجأون إلى تسويات مجحفة للخلاص من معاناة التقاضي التي قد تأتي على ما في جيوبهم ثمّ على ما في عقولهم، وخاصةً في عقود مثل عقود الإذعان التي يجد فيها الفرد نفسه في مواجهة قوى لا تعرف إلا لغة السيطرة والتفرّد.
وقد يلجأ البعض إلى ترك حقوقهم لعلمهم أن حالة التقاضي قد تجعل منهم دائمي الإقامة في المحاكم. ولم يكن النظام القضائيّ في بلادنا حِكراً على المحاكم التي تتولّى الدولة تشكيلها والرّقابة عليها، فقد عرف مجتمعنا الأردنيّ قضاءً عشائرياً، وتسويات تنتهي بالإسقاط في غالب الأحيان نظراً لطبيعة العلاقات السائدة في هذا المجتمع. وقد تراجع دور القضاء العشائريّ لصالح القضاء الحكوميّ لِما يحققه الأخير من وضوح في الإجراءات وعدالة في توزيع الأدوار وسُلطة جبرية تُباشرها الدولة في تنفيذ الأحكام.
ولعلّ الطريقة التي وجدها المشرِّع الأردنيّ وهي إدخال نظام إدارة الدعوى المدنيّة على نظام التقاضي في الأردن كانت بمثابة الحل الذي يمكن أن يسهم في الحد من مماطلات التقاضي وما ينجم عنها من أكوام الأوراق وأثقال التكاليف وضياع الوقت.
وتُوفّر هذه الطريقة (إدارة الدعوى) سيطرةً حقيقيةً على ملف الدعوى بشكلٍ مبكِّر، من خلال بسط موضوع الدعوى أمام قاضٍ متخصص يضع يده على الجرح ابتداءً ويقوم بتشخيص حالة الاختلاف وما قد يناسبها من تدابير، ويطلب من الأطراف حصر بيّناتهم التي تُلائم النزاع على ضوء اتساع مساحة الخلاف أو ضيقها، ثمّ يحاول تقريب وجهات نظر المتداعين وصولاً إلى الصلح وتثبيته في الملف، أو الإشارة عليهم بما قد يساعدهم من وسائل غير التقاضي لحل خلافهم خارج أروقة المحاكم.
