يوجد للدولة كشخصية معنوية - مثل الأفراد - مصالح وحقوق عامة تعمد إلى حمايتها عن طريق تجريم الأفعال التي تضر بها أو تعرضها للخطر، ووضع الجزاء الرادع لها.
والمصالح والحقوق التي ترغب الدولة في حمايتها على صعيد أمنها هي تلك المتعلقة بكيانها في وجهيه الخارجي والداخلي، ففي حين أن الفئة الأولى من هذه المصالح والحقوق تتعلق بسيادة الدولة على الصعيد الخارجي وإستقلالها وسلامتها وهيبتها الدولية، فإن الفئة الثانية منها تتعلق بنظام الحكم الداخلي والدستور ومؤسساته وأمن الشعب ووحدته.
وعلى ضوء ذلك، فإن الجرائم التي تقترف ضد كيان الدولة الخارجي تسمى الجرائم الواقع على أمن الدولة الخارجي، في حين أن الجرائم التي ترتكب ضد كيان الدولة الداخلي تسمى الجرائم الواقعة على أمن الدولة الداخلي.
ويتناول هذا الكتاب الجرائم الواقعة على أمن الدولة في بابين: الأول يتناول القواعد العامة لجرائم أمن الدولة من حيث تاريخها ومعالمها الأساسية والمؤامرة والإعتداء على هذا الأمن؛ والباب الثاني يتناول فئتي جرائم أمن الدولة، فيتطرق إلى فئة جرائم أمن الماسة بالقانون الدولي كخرق الحياد وتعكير العلاقات الدولية، والنيل من هيبة الدولة والشعور القومي، كما يتطرق إلى فئة جرائم أمن الدولة الداخلي من حيث بيان ماهيتها وتعدادها والكلام عن أهمها: كجريمتي الفتنة والعمل الإرهابي.
وقد أريد بهذا الكتاب أن يكون وجيزاً في شرح الجرائم الواقعة على أمن الدولة، ليكون إطلالة عامة على معالم هذه الجرائم الخطيرة، وشرحاً وافياً لأهمها وقوعاً في حالة السلم التي تطمح الدول والشعوب إليها، وترغب في حلولها وإستمرارها دون أن تتعرض للخطر.
