هذه محاولة لدراسة النظرية العامة للعقد في القانون الأردني، سلكت فيها منهج الشرح والتأصيل لمواد القانون الواردة في الموضوع، معتمداً على الأصل الذي استمدت منه تلك المواد، سواء كانت من الفقه الإسلامي، أو القوانين العربية، مع عدم إغفال اجتهاد محكمة الأردنية، وآراء شراح القانون في الدراسات التي سبقت هذه المحاولات.
والحقيقة التي خرجت بها من خلال الاشتغال بالقانون المدني الأردني ودراسته وتدريسه، هي أن هذا القانون يختلف عن غيره من القوانين العربية من حيث الصياغة والحكام واستمداها، كما أنه يختلف عنها من حيث الاهتمام به من قبل الشراح، فلم يحظ بما حظي به القانون المصري والسوري من البحث والدراسة والتأليف إلى عهد قريب
والسبب في نظري يعود إلى أن هذا القانون لم يلتزم نظاماً تشريعياً واحداً، بل خلط أكثر من نظام في وقت واحد، فهو يجمع الفقه الإسلامي، والقانون المصري، والقانون العراقي، وغيرها، وإن كان اعتماده على الفقه، متمثلاً بالمجلة ومرشد الحيران أكثر.
