إن نفاذ القاضي ببصيرته إلى روح القانون، وتشبع وجدانه بفلسفته، لا شك في أنه يجعل إرادة القانون أقوى من نزوات الأفراد، فيفسد على الراغبين في مخالفة القانون محاولاتهم، ويحقق أهداف التشريع التي يرمي إليها من العدل والإنصاف، وإن هذا لا يعني إعفاء المشرع من قيامه بالملاحقات التشريعية من وقت إلى آخر، فيضع من القواعد الجديدة أو يدخل من التعديلات على القواعد القائمة والنافذة ما يكبح جماح الخارجين عن القانون
وهذا هو المعنى الذي تدور في فلكه فصول الكتاب الذي إنقسم إلى أربعة أبواب هي:
الباب الأول (العملية القضائية في تكوين عقيدة القاضي الجنائي) ، الباب الثاني (دور المحامي المدافع عن المتهم في تأسيس وتوجيه عقيدة المحكمة إما نحو براءته من التهمة المسندة إليه أو معاملته بمنتهى الرأفة بحسب الأحوال) ، الباب الثالث (تأسيس عقيدة القاضي الجنائي وأحوال الجزم ببراءة المتهم من التهمة المسندة إليه) ، الباب الرابع (مبدأ حرية القاضي الجنائي في تكوين عقيدته في ميزان محكمة النقض والتزام القاضي بالتدليل على ما جزمت به عقيدته)
