تكتسب الحضانة أهمية كبيرة في المجال القانوني والتربوي والنفسي والإجتماعي والإقتصادي والثقافي والتاريخي والديني، حيث بالإضافة إلى مساهمة التشريعات في إصدار القوانين التي تنظم أحكام الحضانة ودور الحضانة تظهر أهمية الحضانة من الناحية التربوية باعتبار ان المجتمع بمؤسساته التربوية يساهم في مساعدة الأسرة في تنشئة الطفل خاصة في مراحله العمرية الأولى، وفي هذه الدراسة تم الإعتماد على المنهج التحليلي، وذلك من خلال تحليل نصوص القوانين والإتفاقيات الدولية والأحكام والقرارات القضائية وآراء الفقهاء بشأن مواضيع حضانة الطفل، للتوصل إلى معرفة أهم الأحكام المتعلقة بها، من أجل صياغة الحلول والمعالجات المناسبة للمشاكل الناجمة عن حضانة الطفل، بالإضافة إلى المنهج التاريخي، وكذلك المقارنة بين القوانين المختلفة وبناء على ما تقدم، فإن خطة بحث رسالتنا ستكون كالآتي: (الفصل الأول: التطور التاريخي للحضانة "مفهومها، وطبيعتها القانونية"، الفصل الثاني: أحكام الحضانة في قانون الأحوال الشخصية العراقي رقم 188 لسنة 1959 المعدل والمقارن، الفصل الثالث: الحضانة في الإتفاقيات الدولية)، وسنعرض بعون الله في خاتمة الرسالة أهم الإستنتاجات التي توصلنا إليها من خلال بحثنا، وما نراه مفيداً من توصيات ومقترحات.
