قانون التجارة البحرية الاردني هو فرع مواز لقانون التجارة البرية ومع ذلك لم ينل العناية والاهتمام الذي يستحقها من رجال القانون، ولعل العذر في ذلك يرجع الى ان الاردن بلد غير بحري، الا ان ادراك الجهات المسؤولة في الاردن لاهمية التجارة البحرية دفعها الى الاهتمام بميناء العقبة، باعتباره الميناء الوحيد في الاردن حتى اصبح ميناء اقليميا يخدم الاردن كما يخدم البلدان المجاورة، وفي ظل هذا التطور المتنامي في مسائل النقل البحري، كان لابد من الالتفات الى شرح قانون التجارة البحرية الاردني رقم 12 لسنة 1972 الذي ينظم جميع المسائل المتعلقة بالنقل البحري فهو يشمل الاحكام الخاصة بالسفينة باعتبارها الاداة الرئيسة للملاحة البحرية وكذا الاحكام الخاصة باشخاص الرحلة البحرية وطرق استغلال السفينة ومسؤولية الناقل البحري كما ينظم القواعد المتعلقة بالاخطار البحرية والخسارات المشتركة واخيرا الاحكام التي تنظم التامين البحري. وعلى ذلك وجدنا لزاما علينا ان نتولى شرح احكام هذا القانون بدراسة مقارنة، على ضوء الاراء الفقهية التي قال بها فقهاء القانون البحري وكذا على ضوء التطبيق العملي لهذه الاحكام من خلال قرارات المحاكم الاردنية والعربية والاجنبية، علنا بذلك نكون قد اوجدنا في المكتبة القانونية الاردنية ما يمكن الرجوع اليه بشان قانون التجارة البحرية وعلى ذلك فالكتاب ذو فائدة لكل من يتوق لمعرفة احكام هذا القانون من رجال القانون باختلاف مواقعهم ومن رجال التامين ورجال الاعمال ورجال النقل البحري بشك خاص. ولا اخالني ادعي كمالا في هذا العمل، فالكمال لله وحده ولذلك فانني استميح القارئ عذرا اذا ما لمح امرا جانبه الصواب واكون شاكرا لو تفضل بتوضيحه. واخيرا الحمد والشكر لله من قبل ومن بعد فه مولانا فنعم المولى ونعم النصير.
