بعد أكثر من خمسين عاماً مضت على تطبيق قانون الإجراء رقم 31 لسنة 1952 ظهرت الحاجة الماسة والملحة إلى إصدار قانون جديد عصري ينظم أصول وإجراءات التنفيذ في المواد المدنية والتجارية، فأصدر المشرع قانون التنفيذ المؤقت رقم 36 لسنة 2002، بتاريخ 16/7/2002 وبدأ العمل به بتاريخ 15/9/2002 الذي تم إقراره بالقانون الدائم رقم 25 لسنة 2007.
ويتناول هذا الكتاب بالبحث والدراسة قانون التنفيذ رقم 25 لسنة 2007 فيما يخص إجراءات التنفيذ الجبري في المواد المدنية والتجارية وقانون التنفيذ الشرعي رقم 11 لسنة 2006 فيما يخص إجراءات التنفيذ الجبري في المواد الشرعية.
وقد جاء صدور قانون التنفيذ ــ من ضمن حزمة قوانين ــ تنفيذاً للتوجيهات الملكية السامية الداعية إلى الاهتمام بمرفق القضاء وإلى تطوير التشريعات المتعلقة بهذا المرفق بما يؤدي إلى تبسيط إجراءات التنفيذ وسرعة إيصال الحقوق إلى ذويها بأيسر السبل، بما يؤدي إلى القضاء على ظاهرة تعطّل تنفيذ الأحكام والسندات التنفيذية الأخرى وبما يكفل حماية الثقة وتوفير الاستقرار للعلاقات القانونية وصيانة حقوق الدولة والأفراد من الضياع.
ولما كان قانون الإجراء الملغى رقم 31 لسنة 1952 قد أضحى قاصراً عن تحقيق كل هذه الأهداف السالفة الذكر فقد اقتضى الأمر تشريع القانون المؤقت رقم 36 لسنة 2002 للتجديد في المبادئ القانونية الخاصة بالتنفيذ وفي تنظيم أعمال دوائر التنفيذ بحيث تصبح هذه الدوائر أهلاً لأداء مهامها الجسام وقادرة على تحمل الأعباء الملقاة على عاتقها ومحققة للأغراض التي استهدفها هذا القانون.
