يستلزم كل تنظيم قانوني وجود نظام إثبات خاص به يتفق مع طبيعته، ولا يستغني أي نظام قانوني عن الإثبات، إذ لا يمكن للأفراد والمجتمع إقتضاء حقوقهم بغير الإثبات.
وليس أدل على أهمية الإثبات وضرورته أكثر مما جاء بالمذكرة الإيضاحية لمشروع قانون الإثبات المصري من أن قواعد الإثبات المدني تحتل أهمية خاصة إذ إن الحق - وهو موضوع التقاضي - يتجرد من كل قيمه إذا لم يقل الدليل على الحادث الذي يستند إليه، فالدليل هو قوام حياته ومعقد النفع حتى صدق القول بأن الحق مجرد من دليله يصبح عند المنازعة فيه والعدم سواء.
وعلى الرغم من تعدد الدراسات في مجال الخبرة، فإن الكتابة حولها يبقى أمراً ملحاً ذلك أن التطبيق العملي الواسع للخبرة بشكل يومي يجعل من الضروري متابعة هذا الموضوع بشكل مستمر ودقيق وحذر، حيث غن كل يوم يحمل حلقة جديدة من حلقات هذه السلسلة الهامة التي تدعى الخبرة فالمشاكل التي تطرحها الخبرة عديدة وهامة وخاصة في المجال القضائي، فعندما يجد القضاة أنفسهم لعدم تمتعهم بالمعرفة الفنية اللازمة، وهم بكل الأحوال غير ملزمين بإمتلاك هذه المعرفة، ذلك ان مهمتهم تنحصر بتطبيق القانون وهي مهمة قضائية فقط، فالقاضي يحلل الوقائع ويدرسها ثم يطبق عليها القانون.
