نظراً للحاجة الماسة لمرجع مختص يوضح قانون أصول المحاكمات في المواد المدنية والتجارية، فلقد عكفت على إعداد هذا الكتاب، ويتضمن في طيات صفحاته، العديد من الأحكام والآراء والاجتهادات بهذا الموضوع الذي يعد من أهم المواضيع بما يتعلق بالإجراءات التي تتبع لدى المحاكم من حيث كيفية إقامة الدعوى من قبل المدعي، وقبولها شكلاً وموضوعاً، وكذلك التنظيم القضائي للمحاكم في فلسطين، وكل ما يتعلق بالدعوى من البداية إلى النهاية ومن حيث إصدار الأحكام القضائية وطرق الطعن بها، والمبادئ التي تطبقها المحاكم سعياً لتحقيق العدالة مع الأخذ بعين الاعتبار بعض المواد المقررة في قانون البينات حيثما يكون لها محل، وهو قانون مستقل وخاص بموضوع البينات وأدلة الإثبات التي يتقدم بها الخصوم. وهذا القانون إنما يبحث في الإجراءات الشكلية حصراً والتي تتبعها المحاكم، وإن هذه الإجراءات بجميعها تعتبر من النظام العام، فما يميز قواعد هذا القانون أنها بمعظمها قواعد آمرة أي لا يجوز مخالفتها وإلا فيكون مصير المخالفة البطلان.
أمّا عن مسألة حصول الفرد على حقوقه في الماضي، فكان يقوم بحماية حقه بنفسه أو بمساعدة غيره سواء من أقاربه أو معارفه أو بحكم انتمائه لعشيرته، بتلك الوسائل البدائية أو ما كان يطلق عليها بالقوة السافرة، وبمرور الزمن كان لا بد من ظهور وسائل أكثر تمدناً كالتحكيم أو اللجوء لشخص يعرف بحنكته أو بمعرفته بالنزاعات وحلها كأن يكون شيخ العشيرة، وبعد ظهور نظام الدولة فإنه أصبح لها دور في حل النزاعات بوسائل أكثر نجاعة واحتراماً لقراراتها وسلطتها، فظهرت فيما بعد السلطة القضائية لتمارس اختصاصات منها النظر في النزاعات والخصومات وتقضي بها، وكان لا بد من وضع قواعد تنظم عمل هذه السلطة سواء بلوائح أو قوانين على سبيل المثال: قانون تشكيل المحاكم وقانون السلطة القضائية وقانون الإجراءات المدنية أو ما يسمى بقانون أصول المحاكمات الحقوقية أو المدنية (في مجال النزاعات المدنية) وهنالك أيضاً بالمقابل قانون أصول المحاكمات الجزائية بما يخص النزاعات التي تختص بالجرائم بناء على الشكاوى والادعاء العام وهذا مجال آخر لا داعي للتوسع به هنا، فإن المجال الذي نبحث فيه هو البحث في الأصول المتبعة في النزاعات المدنية والتجارية وليس الجزائية.
