لقد سلك تنفيذ الأوامر والأحكام والقرارات القضائية منها وغير القضائية طرقاً متعددة منذ الأزل، إذ كان الشخص يلجأ إلى تنفيذ ما يريد بقوته البدنية وفق تقديراته الذاتية وحسب الظروف المحيطة به شخصياً وتلك الخارجة عنه، وقد كان الشخص كذلك يستعين بغيره لأجل تنفيذ ما يريد من خصمه سواء أكان له حق في ذلك أم لم يكن. ومن خلال دراستنا لكتب التاريخ وسيرة الأقدمين نجد أنه كان يُلجأ إلى استيفاء الحقوق بالقوة المحضة دون هوادة أو تقدير لأي اعتبارات، وهذا ما كان يطلق عليه ــ وما يزال ــ بشريعة الغاب، والأمثلة على ذلك، أخذ الثأر. وبخصوص موضوع هذا الكتاب (التنفيذ) الشارح لقانون التنفيذ الفلسطيني رقم 23 لسنة 2005 فإنه يعتبر الخلف لقانون الإجراء الأردني(رقم 31 لسنة 1952 وكذلك ذيل قانون الإجراء الأردني رقم 25 لسنة 1965 الذي كان سارياً في الضفة الغربية حتى سريان هذا القانون الذي يتضمن (172) مادة والذي يعتبر من أحدث القوانين إضافة إلى أنه يكرس الموازنة بين مصالح الخصوم خاصة بما يتعلق بالحجز بنوعيه التحفظي والتنفيذي والتي قد يجري فيها بيع أموال المدين المحجوزة بالمزاد العلني، وغير ذلك من إجراءات تتسم بتوخي العدالة بقدر المستطاع.
وبصدور قانون التنفيذ الفلسطيني فإنه قد عالج الكثير من الهنّات التي كانت في القانون الملغى. وعملية التنفيذ مهمة تقوم بها السلطة التنفيذية في بعض من حالاتها كحبس المدين بعد إصدار القرار من قبل قاضي التنفيذ، وفي بعض منها يتم عن طريق دائرة الأراضي والمساحة إذا كان التنفيذ على عقار المدين، أو قد يتم عن طريق المصرف أو الشركة إذا كان المدين لديه أموال أو أسهم في كليهما، كل ذلك بعد صدور قرار من قبل قاضي التنفيذ، وهذا ما سنقوم باستعراضه في سياق هذا الكتاب.
