سيادة الأمة .. لا تعني أن الشعب هو معيار المبادئ والقيم والأخلاق كما يتصور البعض . بل المعيار من حيث المنطق هو المرجعية التي يؤمن بها الإنسان سواء كانت دينية عقدية/أو فليفية وضعية ، ومعرفة الحلال والحرام في الإسلام لا يكون من خلال الاستفتاء الشعبي ، وإنما من خلال مصادر التشريع في الإسلام وعلى رأسها الكتاب والسنة .. لكن خلع السلطة والسيادة على تلك القيم والالإكار وتحويلها م سيادة الأمة .. لا تعني أن الشعب هو معيار المبادئ والقيم والأخلاق كما يتصور البعض . بل المعيار من حيث المنطق هو المرجعية التي يؤمن بها الإنسان سواء كانت دينية عقدية/أو فليفية وضعية ، ومعرفة الحلال والحرام في الإسلام لا يكون من خلال الاستفتاء الشعبي ، وإنما من خلال مصادر التشريع في الإسلام وعلى رأسها الكتاب والسنة .. لكن خلع السلطة والسيادة على تلك القيم والالإكار وتحويلها من مجرد قناعات أخلاقية إلى قوانين دستورية سيادية تطبيقية هي وظيفة الشعب من حيث الأصالة والامتياز .
بعبارة أخرى : وظيفة الاستفتاء هو الاحتكام إلى إرادة الناس ، حين تتصار القيم والإرادات ، فيتم حسمها بمسار سلمي وحضاري ، لا بمسار الحروب والاقتتال والإرهاب والقمع وسفك والدماء وانتهاك الحرمات ، كما كانت عادة الشعوب قديماً ، حيث كان المنتصر والمتغلّب هو من يملك الحق في فرض قناعاته وإراداته دون الرجوع إلى إرادة الشعوب .
من هنا كانت سيادة الأمة قبل تطبيق الشريعة .
