لم يجد المسلمون في الدين ما يمكن اعتباره مدوّنة تشمل قوانين عامة متعلقة بممارسة السلطة كما أنهم لم يجدوا ترتيبات قانونية تنظم مسألة الخلافة في حال تعذر على الرسول القيام بمهامه أو في حال وفاته. نستنتج ممّا سبق أن ما تمّ تسميته نظام حكم في الإسلام لا يحتكم إلى شرعية قرآنية بل هو مجرد وصف للتجربة التي مرّ المسلمون بها و هم تحت سيطرة الخلفاء و الملوك و السلاطين - و في الفترات لم يجد المسلمون في الدين ما يمكن اعتباره مدوّنة تشمل قوانين عامة متعلقة بممارسة السلطة كما أنهم لم يجدوا ترتيبات قانونية تنظم مسألة الخلافة في حال تعذر على الرسول القيام بمهامه أو في حال وفاته. نستنتج ممّا سبق أن ما تمّ تسميته نظام حكم في الإسلام لا يحتكم إلى شرعية قرآنية بل هو مجرد وصف للتجربة التي مرّ المسلمون بها و هم تحت سيطرة الخلفاء و الملوك و السلاطين - و في الفترات الأكثر قرب- زعماء بعض الدول التي تسمى إسلامية-. وسنؤكد تكرارا أن الشريعة هي قانون وضعي وقع سنّه من قبل العلماء و الفقهاء انطلاقا من القرن الثاني بعد وفاة الرسول.
