حقيقة لا يمكن تجاهلها وهي ان بقاء المال المشاع على الشيوع يعني دوام الخلافات بين الشركاء في اغلب الاحيان ، الامر الذي يحول دون الانتفاع الامثل بالمال المشاع والتصرف به ، لذلك لابد الخروج من هذا الوضع بقسمة المال الشائع من اجل استمرار التعاون بين الشركاء ، مما يشكل حافزا على العمل وحسن التصرف ، وينعكس ذلك بدوره على المصلحة العامة للمجتمع ، فقد تزول حالة الشيوع بأسباب متعددة منها ان يصبح المال مملوكا لشخص واحد سواء من الشركاء او من غير الشركاء عن طريق الشراء او الارث ، او قد تزول حالة الشيوع من خلال نزع الملكية للمنفعة العامة مقابل تعويض عادل ، او بهلاك المال المشاع ، او غير ذلك من الاسباب ، لكن الغالب تزول الملكية الشائعة بقسمة المال الشائع واختصاص كل شريك بجزء مفرز يعادل حصته منذ بدء الشيوع ، لكن قد يحصل عدم تمكن الشركاء من الاتفاق على القسمة ، او يتفق الشركاء لكن احدهم غائب او محجور ففي هذه الحالة تتم القسمة جبرا على بقية الشركاء من قبل المحكمة عن طريق دعوى قضائية ترفع من قبل الشركاء او احدهم وهي دعوى ازالة الشيوع . الكلمات المفتاحية : دعوى – القسمة – القضائية – لإزالة - الشيوع
