ليس بخاف ما للتأمين من أهمية في عصرنا الحاضر كوسيلة يتم بها درء بعض المخاطر التي يتعرض لها أفراد الشعب ولا يستطيعون تحمل أعبائها، وخاصة مع التقدم التكنولوجي وازدياد حركة الحياة واتساع خطوتها واضطرار الفرد إلي التعامل مع الآلآت في كثير من مناحيها، مما أنتج ازدياد فرصة الحاقه بضرر قد ينوء بحمله مما يدفعه إلي البحث عمن يشاركه في هذا الحمل.
ومن هنا ظهرت شركات التأمين بما تقوم به من تأمين الناس ضد المحاطر، وبجوار أهداف أخري قد تربوا إلي تحقيقها وعلي رأسها تحقيق الربح من وراء عمليات التأمين. ولهذا ظهرت الحاجة ملحة إلي وضع نظام شامل لعقد التأمين يكفل حماية المؤمن لهم من التورط في الإلتزام بعقود هي بطبيعتها من عقود الإذعان.
ودراسة الأحكام العامة لعقد التأمين تتطلب التعرض للعناصر الآتية: "الباب التمهيدي: نتناول التعريف بالعقد وحكمه ونشأة التأمين وأنواعه، في الباب الأول: نقوم بدراسة أركان العقد أطرافه ومحله، في الباب الثاني: نفصل القول في آثار العقد بالتعرض لالتزامات طرفيه، في الباب الثالث: نتناول طرق إنهاء عقد التأمين".
