كان وما يزال موضوع حقوق الإنسان يحتل مركز الصدارة في حقل الدراسات الشرعية والدولية والدستورية. ولم يقتصر هذا الاهتمام على الباحثين فى حقل الاختصاص، ولكن امتد للمهتمين بالإنسان وحقوقه عمومًا. والملاحظ أن هناك اهتمام مضطرد بمسألة حقوق الإنسان، رافق هذا الاهتمام انتهاك متزايد لهذه الحقوق من جانب القابضين على السلطة في بلدان العالم الأقل تطورًا ومن جانب الدول الكبرى وعلى حد سواء، وربما وقف وراء هذا الانتهاك المتزايد انعدام الجزاء المترتب عليه أو اصطباغه بالطابع المعنوي. ومن المؤكد أن جزاء لا يصطبغ بالطابع المادي والتعويض لا جدوى من ورائه في ظل عالم يهيمن عليه طابع القوة والبقاء للأقوى.
لقد تناول هذا الكتاب موضوع حقوق الإنسان بين النظرية والتطبيق في سبع فصول كالتالي: دراسة معنى الحق والحرية وتطور مفهومهما على الصعيد الإنساني، أما الفصل الثاني تناول الحقوق والحريات الشخصية، أما الفصل الثالث: الحقوق والحريات الفكرية، أما الفصل الرابع: الحقوق والحريات السياسية، فى حين تناول الفصل الخامس دراسة الحقوق والحريات الاقتصادية والاجتماعية والثقافية، وجاء الفصل السادس لدراسة الحقوق والحريات التي تقبل التقييد وتلك التي لا تقبل التقييد في الدستور العراقي النافذ، وأخيرًا تناول المؤلف في الفصل السابع ضمانات الحقوق والحريات في الدستور العراقي لسنة 2005. باعتبار أن لا معنى للحديث عن حقوق الإنسان وحرياته دون ضمانات من شأنها حماية هذه الحقوق والحريات والذود عنها عند المساس بها أو تعرضها للانتهاك.
