إن موضوع القناعة الوجدانية للقاضي الجزائي ورقابة القضاء عليها، من المواضيع التي أثارت العديد من التساؤلات، لذلك قام المؤلف بدراسة بعمق والوصول إلى الحقيقة الواقعية لكل سؤال من هذه التساؤلات، وذلك بعد الدراسة العميقة والإطلاع الدقيق على القوانين الجنائية المختلفة، وقوانين أصول المحاكمات الجزائية في كثير من بلدان العالم، يضيف بعداً جديداً في تشريعاتنا الجزائية بشكل يجاري دول العالم المتقدم. وينطلق مفهوم هذه الدراسة إن القاضي الجنائي يستطيع أن يبني قناعته الوجدانية وأن يؤسس حكمه على أي عنصر من عناصر الإثبات، فإذا تكونت قناعته في معنى البراءة أصدر حكمه بها، وإذا كانت قناعته بالعكس قد تأسس في معنى الإدانة أصدر حكمه بها، لكن هناك بين هذين المعنيين المتناقضين وضع وسط هو الشك (Ledaufe) الذي يحول بين القاضي وبين تأسيس قناعته، ويفرض المنطق على القاضي في هذا الوضع أن يصدر حكمه بالبراءة، لأن وجود هذا الشك معناه أنه لم يقتنع بالإدانة، وهذا الإقتناع شرط لصحة صدورها، وهو أمر قد يوحي بأن مبدأ الشك يفسر لصالح المتهم هو نتيجة من نتائج القناعة الوجدانية للقاضي، فالحكم يجب أن يستند على أسباب يقينية وهو ما يفرض استبعاد كل فرض الشك والإحتمال، وأن حرية القاضي في القناعة ليست إذاً من نوع الحرية المطلقة، أو التحكيمية، كما وأن القناعة المطلوبة في المواد الجنائية ليست هي الإنطباع العاطفي، بل هي القناعة العقلية المؤسسة على أكبر قدر من اليقين، وهي درجة لأزمة في الحكم الجنائي بصرف النظر عن جسامه الجريمة الصادر بها، فظهور الحقيقة الواقعية ضرورة إحتمالية والحكم الخطأ يضر بالمحكوم عليه أياً كانت جسامة الجريمة أو درجة العقوبة.
