تشكل الحقوق والحريات هاجس للإنسان ومصدر أرق له منذ بدء الخليقة، حيث أن تعقب مسيرة حقوق الإنسان عبر التاريخ لا تشير إلى لحظة زمنية بدأت عندها، بل أن حقوق الإنسان نشأت عندما بدأ الفراد يعيشون حياة مشتركة بحكم أن الإنسان كائن إجتماعي بطبعه، وقد غنى المفكرون والفلاسفة بالتنظير لحقوق الإنسان والمطالبة بصونها، وبفضل ثورات الشعوب أمكن استخلاص حقوق الإنسان وإقرارها من قِبل السلطات العامة.
يستعرض هذا الكتاب تطور مفهوم الحقوق والحريات العامة وسبل تنظيمها وضمانات حمايتها من خلال القوانين الناظمة لها، وخصوصاً أن تنظيم حقوق الإنسان انتقل من التنظيم الداخلي داخل الدولة إلى التنظيم العالمي الدولي، فأصبحت حقوق الإنسان تتميّز بأنها ذات صبغة عالمية بموجب ميثاق الأمم المتحدة، والإعلان العالمي لحقوق الإنسان الذي يقوم على مرتكزات ثلاث هي:
الحرية والمساواة وعدم التمييز، وهذا يعني أن حقوق الإنسان ذات صبغة وصفة موضوعية وليست تعاقدية، كما أنها حقوق غير قابلة للتجزئة، بمعنى أن الأصل أن يتمتع الأفراد بكافة حقوق الإنسان، بمعنى أن تمتع الفرد بأحدها يعتمد على تمتعه بباقي الحقوق.
ولكن، الإقرار بحقوق وحريات الأفراد لا يعني ممارسة هذه الحقوق والحريات على إطلاقها دون تنظيمها، ووضع الضوابط والقيود اللازمة لممارستها وذلك دون منع أصل الحرية، من هنا جاء دور القوانين والنظم السياسية الناظمة للحقوق والحريات العامة، والتي تختلف تبعاً لاختلاف المذهب السياسي الذي تتبناه الدول وخصوصاً لمسألة علاقة الفرد بالمجتمع، ومصلحة أي منهما تعلو على الآخر.
إن ما سبق يشكّل مضمون هذا الكتاب الذي توزّع على ثلاثة فصول بحثت في ما يلي: الفصل الأول: الحكم الديمقراطي واشكال النظام التمثيلي. الفصل الثاني: الحقوق والحريات العامة في الدولة القانونية. الفصل الثالث: الحقوق والحريات العامة في الدولة الأردنية.
