بصدور دستور 1996، تم الارتقاء بالمجلس الأعلى للحسابات إلى مصاف الهيئات الدستورية استجابة لتوصيات العديد من الهيئات الدولية والإقليمية للرقابة العليا على المال العام، كما تم ترسيخ لا مركزية الرقابة على المال العام بالنص على إحداث المجالس الجهوية للحسابات كقضاء يتولى مراقبة حسابات الجماعات المحلية وهيئاتها وكيفية قيامها بتدبير شؤونها . على إثر ذلك صدر القانون رقم 62.99 بتاريخ 13 يونيو 2002 المتعلق بمدونة المحاكم المالية، عمل على إعادة النظر في تشكيل واختصاصات المجلس الأعلى للحسابات بغية تفعيله للاضطلاع بدور المساهمة الفعالة في عقلنة تدبير المال العام . فما هو الإطار القانوني الذي ينظم تشكيل واختصاصات المجلس الأعلى للحسابات ؟ وما هي الضمانات التي يوفرها القضاء المالي ؟ و إلى أي حد نجح المجلس الأعلى للحسابات في تحقيق مهامه وأهدافه ؟ وما مدى مساهمته في الرقابة الفعلية لحماية المال العام ؟ وأخيرا ما هي المشاكل والعراقيل التي تعترض مهمة المجلس الأعلى للحسابات ؟
