تخضع قواعد المسطرة المدنية لمقتضيات الظهير الشريف بمثابة قانون رقم 1.74.447 الصادر بتاريخ الصادر فـي رمضان 28) 1394 شتنبر 1974) وتشمل القواعد العامة المطبقة في القضايا المدنية والاجتماعية والتجارية والإدارية، وتشكل بذلك قانونا عاما للإجراءات، وقد نجد في المسطرة المدنية، في هذه الحالة، مقتضيات خاصة ببعض الإجراءات وذلك إذا قرر المشرع إخضاع بعض القضايا لمساطر معينة. وقد عرف قانون المسطرة المدنية عدة تعديلات وتغييرات لملاءمتة مع التطورات والتحولات التي يشهدها المجتمع المغربي من خلال عدة قوانين وتشريعات وهي كالاتي ׃ 1- القانون رقم 24.80 بمقتضى الظهير الشريف رقم 1.80.348 بتاريخ 11 رجب 6) 1402 ماي (1982 2- القانون رقم 18.82 الصادر بمقتضى الظهير الشريف رقم 1.82.222 بتاريخ 9 محرم 5) 1405 أكتوبر (1984 3- القانون رقم 04.82الصادر بتنفيده الظهير الشريف بمثابة قانون رقم 1.93.206 بتاريخ 22 ربيع الأول 10) 1414 بتمبر (1993 4- القانون المالي رقم 14.97 الصادر بمقتضى الظهير الشريف رقم 1.97.153 بتاريخ 24 صفر 30) 1418 يوليوز (1997 5- القانون المالي رقم 12.98 الصادر بمقتضى الظهير الشريف رقم 1.98.116 بتاريخ 28) سبتمبر (1998 6- القانون رقم 15.00 الصادر بمقتضى الظهير الشريف رقم 1.00.327 بتاريخ 27 شعبان 1421 (24 نوفمبر 2000) 7- القانون رقم 85.00 الصادر بمقتضى الظهير الشريف رقم 1.00.345 بتاريخ 29 رمضان 26) 1421 ديسمبر (2000 8- القانون رقم 48.01 الصادر بمقتضى الظهير الشريف رقم 1.02.12 بتاريخ 15 ذي القعدة 29) 1429 يناير (2002 9- القانون رقم 19.02 الصادر بمقتضى الظهير الشريف رقم 1.02.109 المؤرخ في 13 يونيو 2002 10- القانون رقم 72.03 الصادر بمقتضى الظهير الشريف رقم 1.04.23 بتاريخ 12 من ذي الحجة 29) 1429 فبراير (2004 11- القانون رقم 05.25 الصادر بمقتضى الظهير الشريف رقم 1.05.113 بتاريخ 20شوال 1426الموافق 23 نونبر2005 12- القانون رقم 08.05 الصدر بمقتضى الظهير الشريف رقم 1.07.169 بتاريخ30نونبر2007 يقضي بنسخ وتعويض الباب الثامن من القسم الخامس من قانون المسطرة المدنية.
