الدعوى الجنائية هى مجموعة الأعمال الاجرائية التى تهدف الى التحقق من وقوع الجريمة ونسبتها إلى فاعلها- وهى بذلك تشمل جميع الاجراءات التى تباشر منذ اول عمل من اعمال التحقيق حتى صدور حكم بات.
والعمل الاجرائي لكل يكون صحيحا لابد له من توافر شروط موضوعية تتعلق بالإدارة والأهلية الاجرائية، وما يتطلبه القانون من شروط خاصة بالمحل المنصب عليه العمل وسبب القيام به وشروط شكلية تتعلق بالشكل الذي يجب أن يصاغ فيه العمل الاجرائي فإذا توافر في العمل الاجرائي الشرط القانوني المتعلقه به سواء من الناحية الموضوعية او من الناحية الشكلية كان صحيحا ومنتجاً لآثاره القانونية أما إذا تخلف عن العمل الإجرائي شرط من الشروط القانونية فإنه يعتبر مخالفا للقانون ويسمى الجزاء الاجرائي.
والجزاءات الإجرائية متعددة منها البطلان والانعدام والسقوط وعدم القبول ويقتصر البحث على البطلان لذلك وجب تمييزه عن النظم القانونية المشابهة له والجزاء يتمثل في تجاهل الاجراء وعدم الاكتراث به وتفويت الغرض المقصود والقواعد الاجرائية تعمل كلها على كفالة ظهور الحقيقة وإقامة الحق على أكبر قد ممكن من السرعة حتى لا يمتد الأمر على المتهم البريء او حتى لا يطول الوقت على اقتراف الجريمة بما ينال من الفورية اللازمة في الصاق الجزاء بها، وحول هذا وما يتعلق به يتحدث الكتاب في دراسة لنظرية البطلان وبطلان التحقيق وتمييز البطلان وشروطه كذلك بطلان المحاكمة والحكم.
