تعد دراسة المياه والمركز البحري أحد الأركان الهامة للدراسات القانونية سواء على مستوى القوانين والتشريعات الداخلية أو على مستوى القانون الدولي العام، وفى هذا الصدد نجد أن كل قواعد القانون الدولي والتشريعات الداخلية قد استقرت على اعتبار أن المياه تشكل عنصراً من عناصر إقليم الدولة، والقانون البحري أو قانون البحار هو مجموعة من النظم والقواعد والقوانين التى تنظم صلاحيات جميع الدول الساحلية المطلة على البحار أو المضايق أو البحيرات والخلجان والمحيطات، وكذلك تحديد المركز القانوني أو طبيعة العلاقة القانونية من حقوق وواجبات للدول المختلفة على الجزء محل الاهتمام، وتنظيم مرور السفن على مبدأ حرية الملاحة البحرية، وتنظيم مسألة استغلال الموارد الطبيعية والحية والبحث العلمي وأهم الاتفاقيات التى تختص بهذا الموضوع: اتفاقية جنيف لعام 1958 واتفاقية الأمم المتحدة الخاصة بقانون البحار لعام 1982 بجامايكا.
