لا يخفى على أحد أهمية النقل بوجه عام، والنقل البحري للبضائع بوجه خاص، بإعتباره من بين أهم أعمدة الإقتصاد الوطني لما يوفره من المبادلات التجارية من إستيراد وتصدير، ولإرتباطه بشكل وثيق بالعلاقات الدولية، حيث أن الصلة بين النمو الإقتصادي لدولة ما وبين تجارتها الخارجية تحكم الصلة التي تربطها بالنقل الدولي.
فالنقل البحري للبضائع يكتسب مكانته الهامة على الصعيد العالمي نظراً لإرتباطه بصورة مباشرة بالنقل التجاري الدولي، وقد لعب هذا النوع من النقل دوراً هاماً في تعزيز شحن البضائع بكميات كبيرة لمسافات بعيدة تعجز وسائل النقل الأخرى على نقلها.
ليس من دولة في العالم إلا وتتأثر بأهمية تطور النقل الدولي ونتائجه على تجارتها الخارجية وبالتالي على نموها وإزدهارها، ولذا فإن معظم الدول تنفق المبالغ الطائلة بهدف إستمرارية عمل أساطيلها البحرية الوطنية.
وقد اهتم المجتمع الدولي بدوره بالنقل البحري للبضائع مترجماً ذلك بعقد الإتفاقيات الدولية التي اهتمت بالنقل الدولي للبضائع عن طريق البحر، لا سيما بعد ظهور السفن التجارية الحديثة والعملاقة والتحسين الذي طرأ على الآلة المحركة وعلى طريقة بناء السفن على وجه عام التي أصبحت وسيلة النقل الأولى لشحن الكميات الهائلة من البضائع بإمتياز، بالإضافة إلى إستعمال المستوعبات في نقل البضائع الذي ترك آثاراً مهمة خاصة لجهة المقاييس النمطية Standard التي باتت الوسيلة الفضلى للنقل المتعدد الأشكال Multimodal.
تسعى هذه الدراسة إلى تناول موضوع النقل البحري في ضوء القانون والمعاهدات الدولية وذلك في فصل تمهيدي وثلاثة أقسام، يتحدث القسم الأول عن مقومات عقد النقل البحري للبضائع، وتناول القسم الثاني: مسؤولية الناقل البحري، في حين عالج القسم الثالث النقل البحري للبضائع، بموجب معاهدة روتردام "إتفاقية روتردام" بشأن عقود نقل البضائع "كلياً أو "جزئياً" بطريق البحر للعام 2008.
