الحمد لله رب العالمين، والصلاة والسلام على أشرف المرسلين، سيدنا محمد، وعلى آله وصحبه وسلم، القائل: "من يرد الله به خيرًا يفقهه في الدين" . أما بعد: فإنه على إثر التعديلات المهمة التي مست قانون الأسرة الجزائري (بموجب الأمر الرئاسي رقم 05/02 المؤرخ في 27 فبراير 2005)، واجتهادات المحكمة العليا الحديثة في مادة المواريث، فقد وجدت من الضروري إعادة طبع كتابنا: "أحكام المواريث في التشريع الإسلامي وقانون الأسرة الجزائري": في طبعة جديدة مزيدة ومنقحة؛ وهذا بعد أن نفدت بسرعة الطبعة الأولى (1996)، وكذا الطبعة الثانية (2004) من هذا الكتاب. وفي هذه الطبعة، تابعت منهجي في دعم الجانب النظري الفقهي ببعض الإضافات المفيدة، والشروح المهمة التي تزيد الموضوعات اكتمالا في ذهن القارئ، بأسلوب سهل ومبسط يتناسب مع المرحلة الجامعية؛ وكذا إثراء الجانب التطبيقي العملي بزيادة الأمثلة التطبيقية والتمارين الحسابية، وتبسيطها في القواعد والطرق. كما أنني اعتمدت الاختصار في المسائل الفقهية الخلافية، حتى أجنب الدارس تشتت الفكر، وطغيان المسائل الفرعية على القواعد الأساسية؛ وهذا ببيان القول الراجح وسبب الترجيح مع الاهتمام بالوضوح والتعليل. وتحقيقا للفائدة المرجوة، حاولت قدر المستطاع التركيز على موقف قانون الأسرة الجزائري في المسائل الفقهية المطروحة، وكذا الاعتماد على قرارات المحكمة العليا الجديدة المتوافرة في قضايا التركات والمواريث حتى صدور هذه الطبعة، ليكون القارئ على بينة من الحكم الذي يتبناه القضاء في المحاكم الجزائرية. ونظرا لأهمية هذا العلم، فقد وجدت نفسي تواقة دائما للكتابة والبحث فيه، بالرغم من كثرة ما كتب فيه، وإني لأتوجه بالشكر إلى طلاب كلية العلوم الإنسانية والحضارة الإسلامية، قسم العلوم الشرعية، بجامعة وهران، لما لمسته فيهم من حب وتقدير، وتجاوب كبير مع المادة من الناحية الفقهية والتطبيقية. وأسأل الله تعالى أن يهدينا إلى سواء السبيل، وأن يجعل ما كتبت عملا صالحًا وعلمًا نافعًا، محققًا للغاية المقصودة، والحمد لله رب العالمين.
