يبحث هذا الكتاب في قانون الأحوال الشخصية الجزائري، وبالتحديد التعديلات حول قانون الأسرة الجديد، بمقتضى الأمر الرئاسي 05/02 المؤرخ في 27/02/2005، بهدف مناقشة الاختيارات التي تبناها المشرع الجزائري، شكلاً ومضموناً، وخصوصاً في مجالي الزواج والطلاق.
وفي هذا الكتاب يناقش الباحث بعض الأفكار التي تناولها جانب من الضفة الجزائري، مع المقارنة بن الآراء الفقهية في مختلف المذاهب وبالترجيح والاختيار، وكذا المقابلة مع بعض التشريعات العربية والغربية المتعلقة بالأسرة والأحوال الشخصية (وخاصة قوانين المغرب العربي والقانون المدني الفرنسي، لأجل تيسر الفهم والنفع العام.
وعليه يعالج الكتاب المسائل المهمة التالية، عقد الزواج بما يحتوي عليه من أركان وشروط، وما يترتب عليه من آثار قانونية، من حقوق وواجبات الزوجين، ونفقة ونسب ونظام مالي بينهما. وبعده يبحث في الطلاق وأنواعه وإجراءاته وآثاره، من عدة وحضانة ونزاع حول متاع البيت.
تأتي أهمية هذا العمل من كونه يسلط الضوء على أول قانون في الوطن العربي قنن أحكام الأسرة في قانون واحد، يشتمل على جميع أحكام الأحوال الشخصية: من زواج، وطلاق، وأهلية وميراث، دون نسيان قواعد الوصية والهبة والوقف. وفق أحكام الشريعة الاسلامية في كل ما لم يرد فيه نص في قانون الأسرة.
