يتناول هذا الكتاب في فصله الأول عقد الصلح في الأموال في الفقه الإسلامي وفي القوانين الوضعية ثم يشير إلى خصائص عقد الصلح في الفقه الإسلامي وفي القوانين الوضعية وأركان عقد الصلح إذ لا خلاف على أن التراضي شرط أساس في الفقه الإسلامي وكذلك في القوانين الوضيعة وفي الفصل الثاني يتناول موقف المذاهب الفقهية من عقد الصلح بأنواعه الثلاثة: الصلح عن إقرار والصلح عن إنكار والصلح عن سكوت إذا لا يوجد خلاف في المذاهب الفقهية الإسلامية على إجازة عقد الصلح عن إقرار وتتقاسم المذاهب الفقهية الصلح عن إنكار أو السكوت ثم ينتقل الكتاب إلى آثار عقد الصلح الإقرار وآثار عقد الصلح عن الإنكار أو السكوت عند فقهاء المسلمين مبيناً موقفهم ، ثم يشير إلى الفسخ والانفساخ على أنهما وسيلتان من وسائل إنهاء عقد الصلح ومن ثم يتكلم عن الآثار المترتبة على الفسخ والانفساخ ويتناول في الفصل الثالث الطبيعة القانونية لعقد الصلح في الفقه الإسلامي والقوانين الوضعية وموقف القانون العراقي والقانون المصري والفرنسي منه لينتقل بعدها إلى الأساس القانوني للطبيعة الكاشفة لعقد الصلح ثم يبين نظريات تحديد الأساس القانوني للطبيعة الكاشف لعقد الصلح فالنظرية التقليدية ونظرية"دسرتو" والنظرية الحديثة.
