يتناول هذا الكتاب بالبحث شرح قانون أصول المحاكمات المدنية رقم 24 لسنة 1988 المعدل بالقانون رقم 14 لسنة 2001 والقانون رقم 20 لسنة 2005 والقانون رقم 16 لسنة 2006 ويشتمل هذا الكتاب على شرح هذا القانون وأهم القوانين المكملة له والتي تعنى بتشكيل المحاكم وإجراءات التقاضي وإصدار الأحكام القضائية وطرق الطعن فيها، وهي قانون الوساطة لتسوية النزاعات المدنية رقم 12 لسنة 2006 وقانون محاكم الصلح رقم 15 لسنة 1952 المعدل بالقانون رقم 30 لسنة 2008 وقانون تشكيل المحاكم النظامية رقم 17 لسنة 2001 المعدل بالقانون رقم 31 لسنة 2008 وقانون استقلال القضاء رقم 15 لسنة 2001. ويتمتع قانون أصول المحاكمات المدنية بأهمية كبرى، إذ إن النشاط اليومي لمرفق العدالة ــ بجناحيه القضاء والمحاماة ــ مرتبط بهذا القانون، ففي كل يوم وفي كل جلسة ولدى كل محكمة من المحاكم المدنية تثار مسألة أو أكثر تتعلق بقانون أصول المحاكمات المدنية منذ إقامة الدعوى حتى اكتساب الحكم الدرجة القطعية. وقد جاءت محاولتي في هذا الكتاب منصبة على شرح قانون أصول المحاكمات المدنية في نطاق التشريعات المعمول بها في المملكة الأردنية الهاشمية، وأملي كبير في أن أسد بهذا العمل المتواضع فراغا في المكتبة القانونية الأردنية التي لا تزال تفتقر إلى المؤلفات الجيدة التي تعالج موضوع هذا الكتاب، حيث إن الحاجة ماسة إلى مرجع عملي وعلمي يتناول شرح قانون أصول المحاكمات المدنية بالدراسة والتحليل. وقد كان هاجسي ــ حين إعداد هذا الكتاب ــ ينصب على اعتبارين: أولهما: أن يكون هذا الكتاب أكاديميا ينهل منه طلبة كليات الحقوق في الجامعات الأردنية حيث إنه جاء وسطا دون إسهاب ممل أو إيجاز مخل بهدف أن يستوعب الطالب أحكامه وتتحقق الفائدة المرجوة منه.وقد راعيت أن يكون هذا الكتاب متسقا من حيث الموضوعات مع الخطة الدراسية لمادة قانون أصول المحاكمات المدنية في الجامعات الأردنية بما يتفق مع الزمن المقرر لتدريس هذه المادة. وثانيهما: أنه لم يغب عن بالي تلك الفئة العريضة من رجال القانون فيفيد منه الباحثون وأساتذة الجامعات والقضاة والمحامون. وقد حرصت على الإشارة إلى موقف القضاء الأردني متمثلا بمحكمة التمييز وذلك بتعزيز الكتاب بأحدث الاجتهادات الصادرة عن محكمة التمييز لما للأحكام القضائية من أهمية في فهم النصوص القانونية باعتبار أن الأحكام القضائية تطبيق للنصوص القانونية.
