الجريمة في نظر الفقه الجنائي هي "كل فعل أو إمتناع عن فعل صادر من إنسان مسؤول ويقرر له القانون عقاباً أو تدبيراً إحترازياً.
وفي نظر العلوم الإجتماعية هي "كل فعل يعتبر مخالفاً للحاجات الأساسية والمصالح الرئيسية لمجتمع معين أو يمثل خطراً على المجتمع أو يجعل من المستحيل تحقيق التعايش والتعاون بين الأفراد الذين يكونونه.
والجريمة بمفهوميها القانوني والإجتماعي، هي فعل يصدر من إنسان في مجتمع، وبالتالي فهي حصيلة عوامل فردية وإجتماعية، وتبعاً لكون ذاتية الفرد مزيجاً من تكوينين بيولوجي ونفسي، فإن العوامل الفردية تنشطر بدورها إلى عوامل بيولوجية وأخرى نفسية، وإن كان في واقع الحال، لا يوجد فاصل دقيق بين هاتين المجموعتين من العوامل لتداخلهما، فضلاً عن إرتباطهما الوثيق من جهة أخرى بالعوامل الإجتماعية، فإن من يرتكب الجريمة هو الفرد، ولكنه لا يعبر في فعله عن فرديته الأصيلة فحسب، بل عن بناء شخصيته المتكونة من إمتزاج المؤثرات الإجتماعية بهذه الفردية.
والإتجاه السليم في دراسة ظاهرة الجريمة لا يجوز أن يقتصر على عامل بيولوجي أو نفسي أو إجتماعي وحده، وإنما يجب في هذه الدراسة إتباع المنهج التكاملي الشامل لبحث العوامل الثلاثة معاً، نظراً لكون السلوك بمختلف أنواعه، وليد تفاعل جميع تلك العوامل، التي تجتمع وتتباعد وتتصل وتنفصل بمقادير وكيفيات متباينة وفي أوقات مختلفة، غير ان ذلك لا يحول دون دراسة كل عامل على حدة، وإستخلاص نتائجه، لإتخاذها أساساً للمقارنة مع ما تسفر عنه دراسة العاملين الآخرين من نتائج.
