إثر تقديم سورية طلب انضمامها إلى اتفاقية حظر الأسحلة الكيميائية بتاريخ 14/09/2013 حصل جدل في الأوساط القانونية بأن انضمام سورية كان بضغط من الولايات المتحدة الأميركية وبالتالي أُكرهت سورية على هذا الانضمام. وكنت طالباً ورئيساً للاتحاد الوطني لطلبة سورية في لبنان، ومعنيّاً بموقف بلادي، مما دفعني للردّ على النقاش القانوني بنقاش وحجة قانونيين، فكان هذا الكتاب. تتمحور إشكالية هذا الكتاب حول انضمام سورية إلى اتفاقية حظر الأسلحة الكيميائية تحت ضغط استخدام القوة والتهديد بها بما يخالف نصّ المادة 52 من اتفاقية فيينّا لقانون المعاهدات الدولية لعام 1969، والتي تنصّ على أنّ انضمام الدول إلى المعاهدات الدولية يجب أن يكون حرّاً خالياً من الإكراه، وإلا اعتُبر الانضمام إلى المعاهدة باطلاً. الأمر الذي يطرح السؤال الأساسي في هذا الموضوع وهو ما مدى مشروعية انضمام سورية إلى هذه الاتفاقية؟ على الرغم من أنّ القرار الصادر عن المجلس التنفيذي لمنظمة حظر الأسلحة الكيميائية – والذي أرفقه مجلس الأمن بقراره 2118- قد أقرّ بالطابع الاستثنائي للوضع الذي تشكّله الأسلحة الكيميائية السورية. تكمن أهميّة هذا الموضوع في آنيّته، حيث لا يزال يتفاعل في أروقة الأمم المتحدة، وتُعتبر اتفاقية حظر الأسلحة الكيميائية وموضوع انضمام سورية إلى هذه الاتفاقية من الموضوعات التي لم يتم البحث فيها نهائياً حتى اللحظة، وهو مقارنة بغيره من الموضوعات، يعتبر وليد الساعة. كما أنّه يرتبط بأحد التّصرفات القانونية لبلادي، لذا عليّ واجب الكشف عن مدى صحّة هذا التصرف القانوني وتبيان ماهيته.
