إن أهمية القسيم الخاص من قانون العقوبات ترجع إلى ضرورة إرتباطه بالوقائع التي تشكل موضوع هذا الفرع من النظام القانوني، فهي وقائع على درجة من الأهمية والخطورة ويستفاد ذلك من الجزاء الذي يوقع في حال إرتكابها وهو العقوبة التي يترتب عليها مساس بحقوق أساسية للفرد كالحياة والحرية والمال والعرض وخلافه، يضاف إلى ذلك إن تحديد وتمييز الوقائع الإجرامية يرجع أيضاً إلى إن دور المشرع لا يقتصر على تجريم أنماط معينة من السلوك، إنما يتناول تقييم كل منها وذلك من خلال الجزاء الذي يقرره لها ومن ثم يمكن تحديد مدى إستهجان المشرع للواقعة، إذ إن ذلك يرتبط بنوع ومدى جسامة الجزاء المقرر لها فتحديد عناصر كل جريمة على حده يساعد على تمييزها عن غيرها كما يفيد في بيان مدى جسامتها ومدى إستهجان المشرع لها.
وسنخصص هذا الكتاب لمجموعة من الجرائم إعتباراً لأهميتها العلمية والواقعية وخطورتها الإجتماعية، إذ إن موضوع كتابنا هذا الجريمة من الوجهة التحليلية قد تمس مال أو مصلحة خاصة بالفرد أو بالدولة أو بالأسرة أو بالمجتمع عامة فهي تتعلق بنواح مختلفة في الحياة الإجتماعية، حيث تتمثل بالجرائم المخلة بالثقة العامة والجرائم المخلة بالوظيفة والجرائم المخلة بالأخلاق والآداب العامة، والجرائم الواقعة على الأشخاص والجرائم الواقعة على الأموال؛ وتتميز هذه الجرائم بأنها تتزايد وتتغير بتقدم المدينة وبتعقد الحياة ومتطلباتها وفقاً لإختلاف الظروف الإجتماعية والسياسية والإقتصادية.
