غابت الحقيقة عن الكثير، وحُملت النصوص على غير محملها، ونشأ الخلاف بين المتأخرين في مسألة الحجاب ( تغطية الوجه) بسبب انقطاع الرِّق أي: العبودية وملك اليمين، وغياب أحكامها عن البعض. فإن الحجاب مختص بالحرية فقد فُرض على المرأة الحرة (لا المملوكة) عن الرجل الحر (لا المملوك)
وكان هذا داعياً للخلاف بين الفقهاء المتقدمين في مسألتين :
1 - جواز نظر ( الأجنبي ) العبد المملوك للوجه والكفين من المرأه الحرة .
2 - مالذي يجب عند خوف الفتنة؛ أن يغض الرجل بصره أم تغطي المرأة المملوكه وجهها.
كان هذا مدار اختلاف الفقهاء المتقدمين في هذه المسألة، والذي أحدث اللبس عن المتأخرين فاستشهدوا بالقول بـ( جواز كشف الإماء المملوكات، وجواز نظر العبيد المملوكين للوجه والكفين من المرأة الحرة) على جواز كشف النساء الحرائر أمام الرجال الأحرار !!
أما وجوب الحجاب ( تغطية الوجه ) على المرأة الحرة عن الرجل الحر؛ فلا خلاف فيه بين أهل العلم المتقدمين، بل الإجماع على وجوبه في المذاهب الفقهية الأربعة.
وابن عباس بريء مما نسب إليه.
وحديث أسماء حمل على غير محمله.
والمرأة الخثعمية كانت من الإماء.
