إنّ الموظف العام هو المحرك الذي من خلاله يمكن لمرافق الدولة تحقيق أهدافها بكفاءة وفاعليّة وصلاحه هو صلاح شؤون الدولة وعلى السلطة الإدارية التي تملك تحديد مسؤوليات الموظفين وكذا إجبارهم على أداء واجباتهم، وفي المقابل اتخاذ الإجراءات الضرورية لتوقيع التأديب على المخطئ وعلى الرغم من أن مبدأ الفاعلية يقتضي أن تمنح جهة الإدارة مساحة من الحرية في تأديب الموظف المخطئ فإنّ الأمن الوظيفي وطمأنينة الموظف تلعب دورًا هامًّا في حفز همته وولائه للقيام بالأعباء الملقاة على عاتقه على خير وجه، وتعتمد الدولة بالدرجة الأولى على المرافق العامة من أجل تحقيق أغراضها وأهدافها المستمدة من سياستها العامة. غير أنّ هذه المرافق هي الأخرى لا تعمل بمفردها، إذ يتطلب ذلك توفر عدة وسائل من بينها الموظفون العموميون. وعلى هذا الأساس يعتبر الموظف العام بمثابة اللبنة الأساسية التي يقوم عليها المرفق العام لأنه يشكل الأداة الفعّالة لتحقيق أغراضه الأساسية لا سيَّما تلك المتعلقة بتقديم الخدمة والمنفعة العامة للمواطن.
هذا ويزداد دور الموظفين أهمِّيَّة خاصة مع اتساع نشاط الدولة وازدياد تدخلها في مجالات اقتصادية واجتماعية شتى مِمَّا يستوجب ضرورة صياغة قواعد قانونية كفيلة بتنظيم الجهاز الإداري للمرافق العامة عمومًا، وتسيير الموظف العمومي بصفة خاصة.
