بات من المسلم به في الفقه أن المسئولية الدولية عن الأضرار الناتجة عن الأنشطة الخطرة أو الأنشطة شديدة الخطورة تنعقد دون حاجة لإثبات الخطأ أو العمل غير المشروع لتلك الأنشطة، فعلى سبيل المثال لا محل للتردد في تطبيق نظرية المسئولية المطلقة عن الأضرار الناشئة عن إستعمال الطاقة الذرية في الأغراض السلمية، ولذلك فيرى البعض أّنه ينبغي إلزام الدولة التي تقوم بأي نشاط ذري وقت السلم بتعويض الأضرار الناتجة عن هذا النشاط على أساس المسئولية المطلقة المتجردة عن نسبة أي خطأ للدولة ومن أهم الاتفاقيات الدولية في هذا المجال، تأتي اتفاقية باريس سنة 1960 حول المسئولية المدنية في الميدان النووي
