"أضحى مفهوم ""حقوق الإنسان Human Rights"" من المفاهيم شائعة الاستخدام في الأدبيات السياسية الحديثة وفي الخطاب السياسي المعاصر بشكل عام، وإن كانت العديد من الكتابات التي استخدمت هذا المفهوم لم تهتم بتأصيله، بل أصبح لشدة شيوعه يستعمل بدون تمحيص وكأنه لا مجال لمراجعته؛ لذا فمن المهم قراءة المفهوم في أصوله الغربية ومقارنته بوضع الإنسان وحقوقه/ واجباته في الإسلام.
وقد اكتسب مفهوم حقوق الإنسان Human Rights قبولاً على المستوى الأكاديمي والمستوى السياسي الدولي على حد سواء، فقد حاولت العديد من الأدبيات العربية إضفاء الصبغة الإسلامية على المفهوم، فبرزت كتابات تتحدث عن ""حقوق الإنسان في الإسلام""، بل صدر بالفعل عن أحد المؤتمرات الإسلامية الدولية ""بيان عالمي لحقوق الإنسان في الإسلام""، واحتفظ بنفس مفردات الميثاق العالمي لحقوق الإنسان الصادر عن الأمم المتحدة مع محاولة إثبات عدم تعارضه مع الإسلام بعرض الأدلة الشرعية التي تساند هذه الحقوق، وهو ما يجعل الإطار الغربي للمفهوم في التحليل الأخير هو المرجعية.
