إن الحديث عن تجديد الفقه السياسي لا يزال متأخراً بمراحل كثيرة عن الحديث عن تجديد الفقه بصفة عامة، حيث هناك تردداً ملحوظاً من قِبَل كثير من الباحثين في المجال الشرعي من الدخول إلى منطقة التجديد في هذا الموضوع، بسبب عوامل عديدة فكرية أو سياسية أو اجتماعية.
في هذا الكتاب مقترح لمراتب النظر في فقه السياسة الشرعية، يبدأ بمرحلة التشخيص ويُعرج على مرحلة التوصيف، وينتهي إلى مرحلة التنزيل، ويدرس في كل مرحلة من تلك المراحل؛ المفاهيم المرتبطة بها والمسالك الموصلة إليها.
وفي هذا الكتاب –أيضاً- تطبيق من تطبيقات تجديد النظر في واحدة من أهم مفاهيم السياسة الشرعية وهو مفهوم (الشوري)، يبحث في أسباب غموض نموذج الشورى في الفقه الإسلامي، ويحاول أن ينتقل بـ(الشورى) كمفهوم نظري إلى (الشورى) كمفهوم إجرائي يقصد إلى (مأسسة الشورى).
