فهذه مناقشة ناقدة لإحدى الظواهر المنهجية التي أسهمت في صياغة فقهنا المعاصر، تلك هي ظاهرة المبالغة في التيسير في مجال الفقه والفتوى، أو فقل: التساهل النمطي الممنهج في الفتوى، وليس المقصود بهذا البحث الترصد لزلل أحد من الناس، أو الإنتصار لمذهب دون آخر، وإنما المراد التذكير بقواعد منهجية من خلال إستقراء الممارسات المتجاوزة حدود الصواب الفقهي، وإرتسام المنهج الفقهي الرشيد.
ويقصد بالتيسير هنا: الآخذ بالأيسر من رأيين متفاوتين في العسر واليسر، إلتفاتاً إلى كونه أخف وأسهل على المكلف، والمبالغة في التيسير إلتزام ذلك على الدوام، بحيث يلفق مذهبه من طائفة من أسهل الأقاويل، فأما الأخذ بالتيسير عند وجود مقتضيه من الأدلة الناهضة فهو المطلوب، وهو غير مقصود بهذا البحث، ولا مدخل له هنا.
