الحمد لله رب العالمين والصلاة والسلام على سيد المرسلين وآله المطهرين
ملخص
الفرائض علم وفن من فقه وحساب وأنساب يرمي إلى توصيل الحقوق لأهلها. والميراث والفرائض إسمان لعلم واحد. يمتاز بنظام حسابي متفرع دقيق، ومن فروع حسابه، الرد، وهو إعادة ما فضل وبقي بعد أصحاب الفروض ولعدم وجود عصبة نسبية، أو عصبة مع الغير لأخذ الباقي، والأصل أنه في هذه الحالة يرجع إلى الخزانة العامة(بيت المال) ولفساد الإدارة المالية، أو قد يكون لاكتفاء المالية العامة، وكان رأي العلماء إعادة الفضلة على أصحاب الفروض بنسبة أنصبتهم، فاعترض قسم وأيد قسم، والذين أجازوا، قسم شمل كل أصحاب الفروض وقسم منع الأزواج، والذين أجازوا وضعوا ضوابط الرد في المسائل بأصول جديدة(2-3-4-5)، وفي حالة وجود الأزواج، استحدثوا معادلة حسابية مفادها بسط المسألة الردية× مقام أحد الزوجين، فظهر لدينا أصل حسابي(16) نتيجة جمع النصف والسدس، مع الزوج، وأصل جديد مستجد(32) لاجتماع النصف والسدس مع(ثمن الزوجة)، وأصل(40) باجتماع النصف+ سدسين، أو اجتماع الثللين+ سدس+ ثمن الزوجة. كان للفقه الجعفري حضور بنظامه بشمول الأب بالرد عليه، والأزواج إن لم يكن غيرهما في المسألة، وبينت الدراسة موقف القانون المقارن من مسألة الرد، وترجح الدراسة رأي سيدنا عثمان بالرد على الأزواج لأنهما يغرمان بالعول، والأولى أن يغنمان بالرد وفق القاعدة، الغنم بالغرم والغرم بالغنم.
