أن ألغاية من رسالتنا المسؤولية التاديبية والجنائية للمحامي هو لمعرفة وتوضيح حقوق وواجبات ألمحامي في كل من العراق وسوريا وفق قانون المحاماة وقواعد السلوك والتنظيم المهني لكلا البلدين والتي يحيطها الكثير من الغموض والمشاكل واهمها نقص البحوث الاكاديمية التي أدت الى عدم الوضوح في المسؤولية التأديبية والجنائية للمحامي ولكونها تعد ضرورة واهمية كبيرة لمهنة المحاماة من أجل ديمومتها وعدم أنحراف أعضائها عن المسار والمبادئ التي جاء عليها قانون المحاماة ومبادئ السلوك المهني في كل من العراق وسوريا لذا فاننا نهدف من خلال بحثنا معالجة هذه القضية بالتفصيل للوصول الى نتائج ايجابية كفيلة بمعالجة هذا الغموض وكذلك معرفة حقوق وألتزامات المحامين اتجاه نقابتهم ومهنتهم وعليه اعتمدنا المنهج التحليلي المقارن للنصوص القانونية الواردة في قانون مهنة المحاماة العراقي والسوري ذات العلاقة بموضوع بحثنا وكذلك أجتهادات فقهاء القانون التي تدخل في منظومة المسائلة والعقوبة التأديبية والجنائية للمحامي بشكل عام ونقابة المحامين العراقية والسورية بشكل خاص وحاولنا المقارنة بين قانون المحاماة وقواعد السلوك المهني والنظام الداخلي لنقابة المحامين العراقية والسورية قدر المستطاع .
