إن المجتمعات الإنسانية ومنذ بزوغ حقبها التاريخية المتعاقبة؛ أدركت صورا متفاوتة للعقوبات الجزائية؛ وهذا الأمر يرد جليا بطبيعة الحال طبقا لسمة الجرائم المرتكبة ومدى تأثيرها وخطورتها وجسامتها على المجتمع، بدءا من الجرائم الفردية البسيطة؛ كالتهكم والسخرية، مرورا بالنفي والإقصاء وانتهاءا بعقوبة الإعدام، كما عرفت العقوبات البدنية كالجلد وبتر الأطراف وجدع الأنوف وسمل العيون، من هنا يمكن القول بأن الإعدام كعقوبة جنائية لم تتبلور بين طيات الفقه الجزائي في العصور الحديثة والمعاصرة؛ وانما منذ قرون طوال خلت، بذلك ارتبطت الجريمة بتواجد المجتمعات البشرية حيثما وجدوا، فقد عدوها ظاهرة طبيعية لما لها من تلازم مضطرد ينعكس إيجابا وسلبا مع ديمومة الحياة، ففي العصورالسالفة كانت الغاية المتوخاة من إيقاع عقوبة الإعدام تتمثل في إنقاذ الجماعة من العنصر المخل بالنظام والأداب والأمن العام، حيث يتم اللجوء لإنفاذها حينما تستنفذ كافة السبل المبذولة من اجل إعادة إصلاح وتأهيل المجرم إلى حاضنة المجتمع .
