تُعد الأسباب المسقطة للعقوبة في الفقه والشريعة الإسلامية أكثر سعة إلى حد ما بالمقارنة مع بواعث زوالها في القوانين والأنظمة الوضعية، ومعنى أن تسقط العقوبات الجزائية المفروضة بحق المدان بأسباب ودواع متفاوتة، فأن ذلك مؤداه أنه يتصور حدوث جريمة جنائية تامة ومستوفية لشروطها الشاملة المكتملة، والتي تستوجب استيفاء مسبباتها إيقاع العقوبة على مرتكبها، إلا أنه ومن ناحية أخرى فإن هنالك أسباباً نشأت وساهمت بدورها في إسقاط العقوبة المفروضة على الجاني، ولكن ليس فيها ما يعد سبباً جامعاً مسقطاً لكل العقوبات، إنما تتباين الأسباب في أثرها المترتب على سريان الأخيرة، فشطر منها يسقط أغلب العقوبات، وقسم منها مسقط لضئيلها، وبعضها يتعلق بعقوبات بحد ذاتها دون سواها .
